Part of Article 15 of the International Covenant on Civil and Political Rights: "Nor shall a heavier penalty be imposed than the one that was applicable at the time when the criminal offence was committed." Whacking people on the park isn't (charged as) a criminal offence, sure, but the principle is there, and the 5 weeks that he got for striking 10 years ago in 2003, is now being counted towards giving him a much heavier penalty, under rule changes made in 2011/12. That is retrospective punishment.
