Presumably, then any legitimate contact within the rules of the game is expected by definition, and consent is implied, and any other contact is not consented to and is assault. I suppose one could argue that it is common knowledge the rules are not commonly applied and therefore anything goes, and it would therefore depend on who the judge barracked for! :wink:

Can't remember exactly but I think the test is what can reasonably be expected. So the unfair bump here and there isn't actionable but a hit like that is. I'm actually thinking of tort law here but I assume it's the same for the purposes of criminal law.

Legal Action.... I understand it can be actionable, but my view is that it's a bit rich given there was no injury (broken jaw or cheekbone) and the AFL have actioned on this via a suspension...

In saying that isn't their a precedent with this and Leigh Matthews??

Assualt is actionable per se which means you don't need damage to sue for it. There would have been pain and suffering plus medical bills here though.

No precedent because a court didn't decide that one, it was settled out of court.

I see Cam Mooney copped a week for his very petty "trip" against the Saints. So the AFL seems to be saying Bazzas death blow is only 7 times as bad as Mooney's indescretion? I know id rather cop 7 ankle taps than be blindsided by a left hook like that one, i like Bazza but i reckon he should have got more than 7.

Also it seems in Oz we have a philisiphy that if violence is carried out on a footy field, its generally ok and "part of the game." I reckon if this happened say over in England in the Premier League, the Bill would already be laying assault charges on Bazz.

Yep, and thats why Australia is ten thousand times better than England! :D

Also if it was soccer, instead of a king hit it would have been a bitch slap and the guy would have had his life support system turned off by now.

I remember Paul Dear getting 5 I reckon for a trip when Peter Foster broke his leg when tripped .A mandatory 1 week is fair enough like most things its not what did, but what could easily have happened

That type of hit with the full body mass pivoting behind as Hall swung his whole body around is potentially crippling [or fatal] depending where it lands, and there is an element of luck in that. The thin bones of the temporal region may have shattered if the impact had been just that bit higher because the WC player tried to duck.

I was just browsing through the messenger and found an article about Gowans return after his suspension, after the sentence Hall got I think "Big Chook's" comment is pretty close to the mark at the bottom of this article.

TBS - I Understand it can be actionable... I'm not a lawyer, but I work with them and know a little bit about it :wink: :wink:

No injury in this case - except a concussion, so while potentially it could have been fatal or crippling, I think it's a bit rich to even look at legal action - given the pain and suffering here was limited to a concussion..

IF he had suffered a Broken Jaw / cheekbone etc.. then I might have a different opinion on the matter...
BUT he didn't.

You can't take injury in to it, yes he should have got 10 but what if the injury healed quick, what if it took longer? What if the Swans said he had no injury at all??
