I'm no expert on war crimes, but just because you didn't have a gun in your hand at the time doesn't mean you're not part of the opposition, in my opinion.
I get we need rules of war, and we can't have soldiers killing kids for fun, but at the same time I don't see why we need to be spending hundreds of millions of dollars against our own guys who we sent over there, asked them to put their bodies on the line, and they did it for us without asking questions.
I can only assume there is more to the story that we don't know.
