Have to say, you'd have a hard time convinving me that's how you search specifically for child porn as opposed to slim or short porn. If (and that's obviously a big if) that is the entire basis of this case then given he's lost his job and the publicity surrounding this is so enormous, I'm inclined to think his request to not have a conviction recorded had merit.
No doubt at all anyone who goes out looking for child porn deserves to suffer for the rest of their lives. But I just can't bring myself to say for sure that there was anything in this that shows an intent to break the law or even negligence that he should have known.
"tiny" is only in one of the search terms he used, some of the others seemed quite specific to me
That was the only one I saw. The article gave the impression that was the term they took issue with. Unless I missed a chunk. News limited journalists aren't exactly the most readable writers I've come across.

hmmm. after reading that i think the judge rightfully dismissed finnigans claims that "it was googles fault"..... how anyone could even think that would be worth a try with the words he used in his search is beyond me.
i also liked where the judge expressed surprise about finnigans claim that he cant afford treatment for his "porn addiction" when he was obviously spending so much money on his defence.
too bad though this couldnt have been handed down 4 years ago when the low life got arrested and saved the tax payer hundreds of thousands on finnigans wages

I've trawled through much of this, I'm fascinated by "court talk" and the manner in which verdicts, judgements and the like are articulated.
Looking at the search terms used, looking at the users penchant for the "art form" it's almost impossible to believe the defence team had any case to state it was Google algorithm that led to Finnigan being exposed to the material.
Again, one must ask, why did this take 4 years?

I'm 3/4 way through it
Quite astonishing that the first 29 pages are about interpretation of the Laws
It took so long because they originally had 6-7 charges which got brought down to 2 and they kept going back to the Supreme Court (that is referenced in the judgement). https://jade.barnet.com.au/Jade.html#ar ... x&t=browse
Note the final District Court one was No 3. Here are the other 2:

I agree it is ridiculous that it took 4 years. I would have got him acquitted in 6 months flat.

Re: The South Australian Political Landscape
Tony Piccolo resigned, press statement:
Over the break, I took time to reflect and consider my position with the Cabinet.
Following Cabinet yesterday, I had my first opportunity to speak with Premier Jay Weatherill.
I told him I was willing to leave Cabinet to assist him in the renewal of the Government.
I think this is the best decision for me at this time in public life.
There is no greater honour than to serve the people of South Australia and I am extremely
proud of what has been achieved during my time as a Minister. I will continue to serve my
community as the Member for Light.
Some of the achievements I am most proud of include:
Negotiating the full roll-out of the National Disability Insurance Scheme. This is one of
Australia’s, and South Australia’s, greatest social reforms. When rolled out, it will mean
fundamental change for the 32,000 South Australian’s living with a disability and bring
them the dignity they deserve to live fulfilling lives.
The re-write of the Firearms Act and ensuring its passage through Parliament. This was
a challenging experience but one I thoroughly enjoyed. As a result, we have the most
robust gun legislation in Australia, with community safety as its primary consideration.
Introducing “no body no parole” – a key election commitment – which is drawing
national attention as a bold initiative.
Changing the parole process for life sentenced prisoners and establishing the Parole
Administrative Review Commissioner.
When my family arrived in Australia in 1963, if someone had told my late father that his threeyear-
old son would grow up to have the opportunity to serve as a Cabinet Minister, he would
not have believed it.
As my father did, I strongly believe in the values and traditions of the Labor movement, which
strive to ensure that everyone is treated fairly and with dignity, in a fair and just society.
It is for that reason I will continue to represent the people of Light, now and at the 2018
election, to ensure that the Marshall Liberal Opposition never has an opportunity to form
Government.
