Its hard for police to get these people to rock up on the day and testify. They are keen when the incident happens but then go walkabout or change their stories or become friends again. Thats why it is difficult to prove 'beyond resonable doubt'. In the end it is just a waste of hundreds of thousands of dollars.

Even if they did testify it would of got thrown out. You gotta have some actual evidence rather then someone say "they saw you do it"

Not neccessarily. They have a thing called a pre-trial, where a judge looks at the general evidence and determines if its possible for the prosecution to get a guilty verdict. Obviously the judge thought there was enough to possibly get a conviction.

Then how did it go to trial.

They had evidence he was there, as well as witness statements that he attacked his cousin. Witness statements do count for a fair bit, until they change them. Then whatever they say is generally worthless.

At the pre-trial the witnesses said it was Jurrah. At the actual trial though, they said something different, and that wouldve been a major factor in him walking free. Nobody would know for sure which version was the truth, the intial statements, or the latter ones. So unless they had concrete evidence he actually did it, there would be a doubt in the mind of the jurors, and hence, he gets found not guilty.
