i don't understand if there wasn't enough evidence to lock him away how was he charged in the first place.

Its hard for police to get these people to rock up on the day and testify. They are keen when the incident happens but then go walkabout or change their stories or become friends again. Thats why it is difficult to prove 'beyond resonable doubt'. In the end it is just a waste of hundreds of thousands of dollars.
