Curtilage

Postby smithy » Wed Jul 01, 2009 3:45 pm

I've had a browse around the net and I can only find the US Curtilage Laws.
Are there any law gurus out there that have info on South Australian curtilage laws please.
Any info is much appreciated.
Thanks in advance.

Ha ha, no I'm not, it's more related to work.
My line of work sometimes requires me to go onto peoples property when they aren't home and I wanted a bit more information.

What I'm curious about is, if given powers by the state, are you allowed to enter someones yard to carry out an investigation and gather evidence (on the basis of presumed innocent till proven guilty), or does the curtilage issue (house and attached yard) come into things, so even though you know the person is not complying with the law, they are (at that point in time) innocent and can therefore tell you to leave their land.

So does the owners curtilage rights over-write other laws or is there exceptions?
