btw they said on the news that if caught they'll be charged with murder & so they ought to be
i thought secret groups were a thing of the past, well not on websites anyway

Yep, So they should.
The people who get murdered or burnt alive don't have a 2nd chance so neither should the person guilty of the offence.

Shrek is spot on.

The State sets the example for it's citizens and State-sanctioned murder purveys the belief that killing can be justified.

It's easy to let emotions overcome rational thought in these situations.

people get away (to an extent) with 'justifiable homicide' now ie battered women, self protection etc

i understand what mr66 & tbs is saying i've been playing the devils advocate & you refuse to see the other point of the discussion which says you haven't an open mind

I'm open to the idea (ie. I accept that this point of view presents itself) that some people feel the need to satisfy their anger or hatred in seeking 'eye for eye' revenge, however, the facts are that State-sanctioned murder has a negative effect on society and I personally don't think we need to lower the standard of living in this country simply to satisfy this irrational desire.

As the eye witness you may be certain, however it is a judge or jury who determines guilt and they must judge the credibility of the eyewitness and can never been entirely sure.

Furthermore even though the witness may be sure they may have been hallucinating, incorrectly identify the offender etc etc. There are an infinite number of ways the eyewitness could be wrong, even though they are very unlikely, but this is what makes the 'beyond any doubt whatsoever' threshold impassible.

Another classic case. Not that I believe in the death penalty anyway but I have a huge problem with "beyond all doubt".

Homicides actually increased with the abolition of the death penalty.
It was only the "insanity pleas" that decreased.
Does that suggest that the weak ba$tards that find the courage to kill someone are too scared to die themselves by pleading insanity?

All crimes have been increasing in number over time so I daresay you can't point to an increase being due to the abolition of the death penalty. As I said before it is unlikely the death penalty has a deterent effect.
