Yeah surely there has to be some burden of proof.....i know its not a criminal trial so "beyond reasonable doubt" would be a bit tough but at very least it would have to be on the balance of probabilites that it happened the way it is being alleged before a player is suspended and loses a chanve at the medal.
Harsh but fair.....

I still keep going back to the "red card" send off, reported and not allowed back on for the rest of the game then found not guilty at the tribunal. Tell me how they think that's fair??

i beleive EP called the umpire up as a witness for the Gatto case but he didnt even turn up.
have been in there before representing someone and at the end of it was pulling my hair out through frustration because they have set their minds on GUILTY MODE before you get in there,
its like you have to prove thier innocence rather than give evidence. i dont think a lot of the panel has actually played the game.
7 days to lodge a report on someone by "a club official" (and i dont think it has 2b opposing club official) is just stupid. Might go down to Kilburn or FP this week, tape the game hold onto it for 6 days then lodge the tape if there is something in it.
But in saying this we are dealing with the AMATEUR League arnt we?

Exactly my problem with it, its almost as if cos you have been sited, you must have done it. Umpires or Officials couldn't be wrong. :roll:

Was discussing this idea a while ago on the div 4 thread.

What burden of proof is the right one for a tribunal? I don't believe there is any mention of a burden of proof in the tribunal rules. How can a tribunal be consistent when they accept various amounts of proof for each case.

Guilty until proven innocent seems to be the common denominator here.

Have also been in representing players and other posters are correct that they have already assessed the case and predetermined the outcome prior to the hearing, which I find down right rude and shows no respect to the accused or others with the short time span allocated for something that really is serious and can have lasting ramifications.

my veiws on the saafl tribunal is that they take way to much into account what club the reported player is from and what club the incident happened against e.g a northen suburbs club would be dealt with more harshly than your toffee clubs like all the uni's and collage sides etc etc etc ( and that is noway a dig at any uni or collage teams) and think what you will but the facts are there just my veiw any thoughts?

there are also questions being raised how you can suspend players for "an incident" that know one seen at all interesting hey wonder what club that was?

St Paul's CHF last night suspended for 6 weeks for abusing an umpire FFS! Seriously that is a joke especially when the player in question was bleeding from the neck after having scratches all down him and struck moments earlier but once again the umps catch the retaliator or is it a case of the opposition being Adelaide Uni? :evil:

Original charge was striking but umpire withdrew this and booked him for abuse....Amateur League may not have updated the paperwork. As far as player and club is aware he was up last night for abusing the umpire.
