A Promissory note is actually legal and can be used, its obviously the conditions he put on it that were the issue.

I actually listened to a couple of his podcasts, not because I agree with his views but I do like to hear alternative opinions, his Pete Evans one was actually well worth a listen, they made a few reasonable points...again not that I agree with either of them.

It's $100k, not $2m, but then again, nothing else he is doing seems to be logical either so perhaps he is willing to declare bankruptcy over $100k.
