To the SA Footy Forum Brains Trust:-

Do funds held in a probate trust account subject to receiving interest (monthly) for the term the funds are held in trust?

If the question is can they earn interest, then the answer is yes providing that account attracts an interest payment.

Thanks, so by that, if the Probate lawyer, or the executor of the trust were diligent, and acting in the best interest of the beneficaries, they would hold funds in a trust account that receives interest, yes?

Nope - neither the solicitor or the client gets the interest

The interest funds a statutory fund (IIRC, the Legal Practitioners Fidelity Fund)

Thanks for that. I have had a chance to have a snoop around on the net, and found that you can elect to hold funds in trust, in an account that does attract interest.

So, by this, neither the probate lawyer, nor the executor of the trust has acted in the best interests of the beneficiaries. Pox!

Sadly these guys are not the probate lawyer we have had. The executor chose some eff wit operator in Qld, who's neck I assume is an interesting shade of red.

I am now faced with the dilema (no win situation) of pointing out what could have been achieved, re boosted beneficary disbursements had the executor paid a little more attention.

I mean how ******* hard is it, to work out that around $500k would sit dormant in a trust account for 7 months, when with a fairly simple "smart" move it could have been working for us. My calc - we've missed out on around $9k in interest.

You can still threaten to sue him as executor

Walking back from OzAsia yesterday popped into Casino.
First time in there for a very very long time....
Some parts they did a good job renovating and others are just appalling.
District set up looks OK, but certainly not amazing from what i had heard previously.

Is it just me that has that view?
Matty Wade is a star and deserves more respect from the forum family!

I hadn't been there for about 25 years, went to a friend's sons 18th a couple of years ago & found there was no longer a 2 up ring. That was my favourite game.
