If you are convicted of an indictable offence you can not hold an office in our parliament.

You are not convicted until sentencing.

That’s what I originally thought, but it seems that if he is a current member, then Parliament must explicitly remove him.

I haven’t looked it up, so not sure to be honest.

With Spiers, Bell and possibly Ellis unable to fulfil their roles at present we could be facing 3 by elections.

Not a good outcome for the constituents of those seats.

Got around to verifying this, it seems that you are indeed correct.

As quoted from ECSA, no mention of convictions. So you can be a candidate for election to SA Parliament but you can't take your seat if you win. #-o

I guess in practice no Party would be stupid enough to nominate a convicted criminal ... The US Republican Party says hello.

What are the eligibility requirements to be a candidate?

A candidate must be properly nominated before they can contest an election for the House of Assembly. A candidate may stand as an independent (unendorsed) candidate OR be endorsed by a registered political party.

A person wishing to nominate as a candidate must be enrolled as an elector for an address in South Australia at the date of roll closure. A person can verify their enrolment at the Australian Electoral Commission .

A person entitled to enrol must be:

- at least 18 years old;
- an Australian citizen, or
- a British subject who was enrolled on either a South Australian, Commonwealth or Territory roll sometime between 26 October 1983 and 25 January 1984 inclusive; and
- of sound mind; and
- a resident of South Australia and has lived at their principal place of residence (for which they claim enrolment) for at least one month immediately preceding the date of the claim for enrolment..

He'll make it to election day cos noone would want the job now, and probably won't be many left after next election if they continually let him in front of a camera.

David Speirs’ house was raided by police on 26 Sept where he was arrested.

Has now announced that he will quit Parliament on Oct 15.

Pretty obvious that he needs help, hope that he gets it.

The charges will take care of themselves through the legal system, but whatever the outcome, innocent or guilty, he has been setup big time to fail.

Whoever his enemies are, and whatever the reason they did what they did, this doesn’t deserve to be brutally played out in public.
