Wouldn't manslaughter be a more appropriate charge? Surely this cop didn't intentionally kill him ?
In South Australia, it's murder where the accused intended to kill, or cause grievous bodily harm, or acted with reckless indifference to the life of the victim. I.e. it can consist of something slightly less than an intent to kill.
In other jurisdictions the situation is similar, although in some American jurisdictions there are different 'degrees' of the offence.
The officer in Minnesota had his leg on the neck of the deceased for 8 minutes and 46 seconds.
Perhaps it's a stretch to say with certainty that he intended to kill; I think though the footage shows the officer at least intended serious harm to the victim and/or was recklessly indifferent as to whether he survived.
The guy pleaded to be released, and was unconscious for the last three minutes, and still the officer didn't get up.
That's why he's been charged with murder. Maybe it's not first degree, and of course more information about the circumstances of the death may well come out, but to me the footage suggests a murder charge is not unreasonable.
