There is a big list of approved substances and you can only take things on that list. Anything outside that list is banned, it doesn't specifically have to be on a banned list.

So why wouldn't you have to prove that what you have taken is on the approved list?

The problem is these so called "sport scientist" make cocktails of drugs, usually made with masking agents or substances new to the market which make it impossible to be detected. There is also a category which only bans a substance because it is not known if it is safe for use. Usually these substances are fresh on the market and don't have any means of testing. This is why when a athlete is known to be receiving injections (which is illegal under ASADA code) they are looked upon as being guilty until they prove they are innocent. The problem for the Essendon players is ASADA have the evidence of them receiving injections and the receipt of the banned substance being purchased. It's now up to the players to prove what they actually received.

Since when is having injections illegal?
Essendon have admitted to injecting AOD and Thymosin Alpha yet have been cleared.
Cooney went to Germany where he received over 40 injections of calf blood in 1 week and this was legal.
Then you have that great AFL GF from a few years backs where after the game cleaners found lots of discarded empty vials of pain killers and Brent Guerra admitted to having 17 jabs to get him up for the game including 3 in the stomach at half time.
None of these guys did anything illegal IMO. Surely its what is in the injection that makes it illegal not the act of simply having a jab

11.5 of the anti doping code which is no needles policy. There is a clause for treating legitimate injuries were no other method is able to be used. The injection is to be given by the club medical officer. You can also use any method or substance which is listed as prohibited by the anti doping code with prior consent.

You just couldnt make this shit up!
Eddie now claiming ASADA offered Charters a job in return for giving up evidence on Essendon. A convicted steroid trafficker working for ASADA what a joke.
Its gets better though with Charters revealing he has transcripts from the before and after meeting with ASADA and that ASADA have altered his testimony to remove the parts that didnt suit them. He has a copy of the documents and tape recordings and now Mick Gatto has offered him $100k to purchase them.

James Hird has more support on Essendon board as new members set to be elected

JAMES Hird supporters Paul Cousins and Catherine Lio have been elected to the Essendon board.

Cousins is a website builder and Lio works in digital communications.

The pair will officially join as directors at Monday night’s annual general meeting.

The pair beat higher profile candidates Ron Gauci and Jason Cunningham.

Cousins and Lio unequivocally backed embattled coach Hird in the campaign.

One other candidate, Bill Jennings, had called on Hird to resign.

Gauci had challenged Essendon chairman Paul Little to seek a mandate from members to continue leading the club in the wake of the continuing drugs saga.

Veteran director Kevin Egan decided not to run in the constitutionally required election, while Jo-Anne Albert has lost her seat.


These were the two I voted for, glad Gauci the AFL plant didnt get in.

Todays hearing was just ASADA trying to subpoena Alavi and Charters, they were never going to win it as they are not employed by the AFL so are under no obligation to attend.
The judge said " your application has failed completely" and even accused ASADA of time wasting. ASADA were also ordered to foot all of the legal bill.
Next weeks trial still goes ahead as ASADA believe they still have enough evidence without their testimonies.
Whilst today was a win for us it was only a small victory and one that still doesnt get us off the hook

He accused them of time wasting because ASADA are still deciding if they will appeal todays decision. The appeal wouldnt be held until mid January at the earliest.
McDevitt says they dont need their testimonies and they have enough evidence yet they are wasting taxpayers money on a case they had zero chance of winning and trying to get them to court, doesnt make sense.
Things will still proceed next week without them but guess we will have to see what evidence they really do have. We also still have the Hird case that concludes in January, if by some miracle he wins then everyone starts again

It was a case they could never have won though which was why the judge made those comments

So hang on Jim, ASADA go to court to subpoena 2 people that gave evidence in a interview. After they lost the case they sat down with their legal to decide if they had a case in a appeal. Which later on they released a statement saying this.

ASADA is pleased these matters are now before the AFL Anti-Doping Tribunal and looks forward to presenting its case commencing next Monday


You also add to the fact that this court case delayed no time what so ever in the case. Now we could talk about Essendon wasting time, to try and find backdoor to get off the charges. When you compare this to what Essendon have done in the past 12months, ASADA look like saints.

Was always going ahead on Monday but ASADA still may appeal todays decision. The judge will give his reasons why he rejected their case on Tuesday or Wednesday next week and depending on the answer they get it will determine if they appeal. The appeal would be held mid January.
The question I ask is why ASADA tried to subpoena two people that were never ever going to be forced to appear in court. Surely ASADA's legal team would of seen that they could never win today, just seems like a waste of time and money

Pretty sure the judge was saying ASADA wasted the court's time on this matter, nothing to do with Essendon or the case against them.

One thing is for sure, the AFL would be stoked that ASADA lost yesterday. If by some miracle ASADA had won the case there would be huge ramifications for the AFL
