Liberals take action on McGee case
The Liberal Opposition is taking direct action to urge Attorney-General Rau to send the McGee case to the Legal Practitioners’ Disciplinary Tribunal (LPDT).
Community concern has flooded Liberal MPs’ offices across the State demanding justice following the ABC’s Australian Story exposé of the case.
The Liberal Opposition will today move a motion calling on Attorney-General Rau to exercise his powers under the Legal Practitioners Act 1981 to refer Mr McGee to the LPDT.
From today, a petition calling on Attorney-General Rau will also be available from Liberal offices for the public to express their concern.
It is now nine months since the Liberal Opposition first called on the Government to refer the case to the LPDT, yet Attorney-General Rau has failed to act and failed to listen.
“Public confidence in police, prosecutors and courts has been significantly undermined,” Shadow Attorney-General Stephen Wade said.
“In spite of the action already taken against Mr McGee, it is important that all reasonable steps are taken to ensure that justice is delivered, now and into the future.”
Under section 82 of the Legal Practitioners Act 1981, only the Attorney-General is now legally able to refer this matter to the Tribunal and the Liberal Opposition is urging him to do so.
Former Attorney-General, Michael Atkinson, has joined the chorus of community concern saying that Attorney-General Rau’s failure to act was a “personal decision, not a Cabinet decision or a Government decision” and that he “has the undoubted authority to refer a charge against a legal practitioner to the Legal Practitioners’ Disciplinary Tribunal” [1].
While a parliamentary motion cannot force the Attorney-General to act, the motion will give voice to the overwhelming level of community concern.

God forbid someone ever be found guilty because, well, they're guilty.


It happens all the time. I'm told something like 80% of trials result in a conviction. Not sure why someone being acquitted of dangerous driving, but found guilty of driving carelessly upsets you.
