Bad News - the ATO

All discussions to do with the SANFL

Wedgie wrote:Just on the target of ATO, something which perhaps is more relevent and has only been briefly discussed before is I wonder how long before the ATO looks at hitting SANFL clubs with a higher rate of tax because of the amount of money being turned over for football related activities?
Some clubs will be looking at ways to spend money on football related things just to keep under the ATO's radar Id imagine.
Perhaps trips interstate and overseas or sporting hubs?
Perhaps clubs will look at buying their ovals or parts of it and redeveloping that? (only after purchasing it of course, it would be folly to redevelop on land not owned by a club)
Shouldn't be a huge problem if they go to school from the right teachers. Rugby League club pokie facilities in Sydney would turn over 10 or 20 times more than the facilities owned by your average SANFL club (and in the case of Penrif Panfers, significantly more than that); but you could bet very safely that they're all paying tax at the rock-bottom discounted rate.

While I'm not a tax lawyer, I would have thought that 'not for profit' means 'not for profit' (i.e. technically, surplus income is never distributed to the members), and the ATO shouldn't dig too deep below that. The income-generating activities of not-for-profits are frequently divorced from the target of their expenditure (e.g. MSF spend all of their money trying to treat sick kids in Africa, but not too much of their income derives from either Africa or sick kids). Then again, tax law is a minefield, so who knows?

PS Presuming that councils own the land for the SANFL suburban ovals (and I know they do in at least a couple of instances), you could very safely bet that they're not selling. Community facilities, not to be handed over to private organisations, many of them used by other clubs (esp cricket), yadda yadda.

Just out of curiosity, do SANFL clubs have to give the SANFL a copy of their tax statement - I presume not (business confidentiality) but just interested --- anyone know for sure :?:

Dinglinga you are a real DINGALING . $700K in tax debt (GST tax debt).
Are you serious that would eqaute to sales or supplies of $7.7 Million dollars.
Shit I wish we could turn over that sort of money. I think you will find the figure closer to
$70K rather that $700K.

Well then if you are talking Income tax (I do not need to do any sums).
Since footy clubs are exempt from income tax.

Also not positive but exremely confident that the social club
is also exempt.

Even if there was a tax liability of 700k. Well that would
equate to a profit comparable to a number of AFL clubs combined.

Can you name what other tax it could possibly be ?

dingalina, now this is my second post.

Selective quoting used for brevity... (NRL article)

.......The Bulldogs have also run into tax problems over the salary-cap scandal in 2002. The ATO has issued penalty notices on Bulldogs Rugby League Club, Bulldogs League Club and almost certainly leading Bulldogs players, claiming incorrect tax returns, failure to keep proper records and issue correct pay-as-you-go tax statements for the 2001 and 2002 tax years, when eight Bulldogs players received as much as $700,000 more than the salary cap in secret payments channelled through the Oasis Development Corporation.

Without accurate payment summaries, Bulldogs players would not have been able to file accurate income tax returns, and consequently could be liable for substantial penalties for the 2000, 2001 and 2002 seasons.

If so, this could have added an extra dimension to the pay deals behind recent transfers of Bulldogs players.

A Bulldogs spokesman declined to comment. The club’s 2004 annual report states: “The directors of the consolidated entity are vigorously defending the claim made by ATO and do not believe a liability will be incurred in respect of this matter.”

Very Very doubtful, as payroll tax in SA is approx 6% (Thats appox $11M in payroll payment, mmm not very likely) . All the taxes that you have suggested are either non applicable or would suggest Sturt is earning extraordinary income (well we know sturt is not earing that much).

Dindaginga, I don't know where you got your info from but it doesn't stand up. Not gettiong techincal but $700K is a very very large amount of tax. And an extremely absurd amout of Income earned before being taxed.

I was at the AGM, not sure to whom (or which accountant) you a referring.
There was a vote however to maintaing the current accounting firm as
their external auditors (but this is current practise each year.

The amount of money you are referring is probably the amount of money that SFC didn't
pay tax on, not the amount of tax actually owed.
