Incorrect.

I have been sitting in jury service for the past month, and my number came up for 2 separate rape/unlawful sexual intercourse (USI) cases :(

Here's a few facts that I've discovered recently about our laws:

Firstly, if she was under the age of 17 at the time of the alleged incident(s) then the police are obliged to investigate. If the players plead not guilty then it will molst likely make it to trial by jury, if the police/prosecution can compile adequate evidence to convince an alleged offence to a jury. The jury will be instructed by a judge that a guilty verdict for USI requires the following, beyond reasonable doubt:

1. That sexual intercourse occurred. This can include normal penis-vagina intercourse, cunnilingus, anal penetration, penetration by any part of the body (e.g. fingers).
2. That the alleged victim was under 17 years of age at time.

If the prosecution proves beyond reasonable doubt (harder to do than you might think) then a judge will instruct a jury to find the accused person/people guilty of unlawful sexual intercourse.

The law also states that some people cannot give consent to sexual intercourse. This includes:

- A person who has sexual intercourse with any person under the age of 14 years shall be guilty of an offence and liable to be imprisoned for life.
- A person who has sexual intercourse with a person under the age of 17 years is guilty of an offence. Maximum penalty: Imprisonment for 10 years.
- A person who, being in a position of authority in relation to a person under the age of 18 years, has sexual intercourse with that person is guilty of an offence. Maximum penalty: Imprisonment for 10 years. The person in a position of authority could be a teacher, foster parent, step-parent, guardian, religious official or spiritual leader, medical practitioner, psychologist, social worker, person employed in correctional institution or training centre, or employer.


Consent has nothing to do with it, unless the accused is charged with rape.

Purch, I understand those to be the laws in SA, apparently in Victoria it is 16 not 17.

Didn't one of the "encounters" happen in Sydney? How would that affect the laws if they were both Victorian citizens?

I was talking to a teacher i know about this when it happened and he said the law here is 16 and a half...

but he is a PE teacher, so prob a bit lax on the "rules"... :lol:

if an offence is committed in Sydney, then NSW law applies- regardless of where the offenders are from.
Good to see the laws work though- paedophile priests flout the law with ease... :evil:

My understanding is the Sydney encounter was just a quick chat and an exchange of phone numbers. The hanky panky occurred back in Melbourne over the coming weeks.

So there is a group on facebook called "Leave {xyz} alone"

Where {xyz} is the girl involved in the scandal.

It's only a small group with about 250 members, however there is a very interesting one on the list.

The crows very own Taylor Walker.
Should we read anything into that or is he just a nice county boy who feels sorry for her?
