In South Australia, it's murder where the accused intended to kill, or cause grievous bodily harm, or acted with reckless indifference to the life of the victim. I.e. it can consist of something slightly less than an intent to kill.

In other jurisdictions the situation is similar, although in some American jurisdictions there are different 'degrees' of the offence.

The officer in Minnesota had his leg on the neck of the deceased for 8 minutes and 46 seconds.

Perhaps it's a stretch to say with certainty that he intended to kill; I think though the footage shows the officer at least intended serious harm to the victim and/or was recklessly indifferent as to whether he survived.

The guy pleaded to be released, and was unconscious for the last three minutes, and still the officer didn't get up.

That's why he's been charged with murder. Maybe it's not first degree, and of course more information about the circumstances of the death may well come out, but to me the footage suggests a murder charge is not unreasonable.

Not sure what protection he will get under the fact he was "doing his job" - albeit extremely poorly. Will there be something they hide behind in terms of he wasn't adequately trained to handle the situation? I suspect they will try and find something to get him off.

As for the victim himself, I heard he was being investigated for fraudulent purchases. Something along the lines of handed over a $10 and pretended it was a $20 when he paid for his groceries. Some claim it was a mistake by him, police are saying they were investigating. Kinda **** up if he's dead and it wasn't him, or even if it was, and it was just a fact of him grabbing the wrong note out of his wallet.
I thought he was busted using a counterfeit $20 note.
Horrible way to die and hopefully the 4 other cops that were helping to pin him down face trial aswell

Anyone seen the video when the ambulance arrived? The officer took his knee of his neck, they rolled him onto a stretcher and bundled him into the ambulance, no attempt to resuscitate or provide medical treatment at all. Id like to know the explanation for that.

Yeah thats what i heard too. Who would know if they are passing a counterfeit note anyway. Hardly your fault if you end up with one randomly.
I did hear a report that the cop that killed him has 12 previous complaints for heavy handed behaviour in 19 years of being a policeman. Sounds like he shouldve been kicked out of the job alot earlier. Looks like a real arrogant typical copper

Im normally really good at handling graphic videos but the entire video makes me feel sick in the stomach.

The human race and society is ****** at the moment.

I hope the police officer gets a life time in jail and doesn't somehow find a loop hole. I heard he has engaged a lawyer who has previously been really successful getting police officers off cases similar to this.

The only hope i have is this is the wake up call that we will not tolerate that bullshit to any human anymore.

Ps. I believe 99.9% of police officers do an amazing job and i support them in having the means to be physical with people when required. This was not one of those cases and was completely unwarranted.

That is just ridiculous..... similar incident happened under Obama and he did nothing....and its happened in the US since adam was a boy. It wont change.
