Actually, Dogger, if what we've been told is correct (not that I have reason to doubt it) then this sounds very much like HN will have to cave in. They may be able to argue their case that they explained and FC didn't understand, but they acted like a guilty party afterwards. That's what will set them on the back foot.

As of Monday I am back working For Cash Converters Different store and i found that over the time if they remove anything off a computer that should be there they can get into alot shite. Cashies that is and alot of them tread carefully around computers.

Still waiting for a reply as to whether they will accept my official request to rescind my contract. I gave them 10 days.

FC's PC Update: Just got a call from HN, " courtesy call" to see how the PC issues were going. I told him that I managed to get the USB drive working, but it still tends to freeze when I put more than one in at a time. Also that I put my camera memory stick in yesterday and it worked, but when I took it out and tried to put it back in later, it wouldnt work. He offered again for their tech to look at it, but at the same time he said that he had "managed to negotiate" a deal with the manager and would sell me Office 07 for $100.

I'm really sick of the whole thing, and open office seems to be working ok. Should I take it?

Stick to your guns FC. They are negotiating and will move to your position if you hold out.

How many days left of the 10 days do they have?

No,hold your ground.I would be wanting a refund as per your letter. They have been less than ethical in their dealings with you and I wouldn't do business with them on that basis.I also don't think I would be talking to them until they respond to your letter, only then would I consider any offer they may make.

Also...

At a guess, $100 for Office 07 would be below cost. By offering this they want to wrap things up with minimal fuss. Don't let them - they owe you a full refund so you can go buy something useful.

Doesnt sound like their going to give me my money back. I'll only end up putting XP in it probably anyway (when Diss has finished his stint on the pro poker circuit  ).

I know its a matter of principle but I really cant be assed to tell you the truth.

Then your only decision is whether or not you wish to part with another $100.

If Open Office does what you need, keep your money and just chase them to ensure everything works properly (your USB drive issue for example).

I'd request a tech to go onsite and fix or at least diagnose your problems on site instead of the office they've offered. They'll fix this problem for you, but my worry would be what happens in the future if something happens to the system. They appear to have been less than helpful so far when it's been brand new, so what will they be like when it's 6 months old?

This could yet take some time and hassle to sort out, so personally I would settle for getting something that works as you requested as quickly and easily as possible while checking out what the future might hold in terms of their warranty policy should you get an actual hardware failure. The other thing is you don't want to be remembered as a problem customer (no matter whether you're justified in your position or not) as they will be less likely to do anything more than bare minimum service in future.

That's what firms rely on when they get complaints...they'll string things out for as long as they legally can in the hope and expectation that you'll give up. I know it's a lot easier said than done but stick to your guns if you can. Don't suppose you know anyone who could put a piece in the local press for you about your treatment...amazing the effect that the threat of bad press can have. Good luck :D

The key words are, "Not fit for purpose." If it doesn't do what is contracted you are entitled to a replacement that does or a refund. They rely on people giving up because they make it too hard, butin the end it is your choice.
