Taking a photo while driving

I figured someone out there would be able to confirm this for me...

If it is illegal to use a handheld phone device whilst driving, I'm also assuming it is illegal to take a photo with said device, or a hand held camera whilst driving. Is this correct?

An affirmative answer may well save me $225.

If the cop did something illegal to snap you, im pretty sure it makes your fine null and void...

That's what I thought.
And, it wasn't a cop. It was a council staff member.
So they've got even less privilege.

I would have thought a fine for indecent exposure would have been a lot more than $225...

It wasn't that indecent, I had footy shorts and a Collingwood guernsey on at the time ;)

If it was a police officer you would be in trouble but being a council worker im pretty sure it would be illegal

It may not be that 2 wrongs negate each other though. If you were doing something that causes a fine I expect the fine will stand.

If he was using a phone while driving thats a separate matter for the police and him. You'd have to prove it somehow.

If you photographed a crime while driving i think the police would say thanks for the photo mate and leave it at that. Would it negate the other crime?

I'd make a quick call to a lawyer to confirm one way or the other.

If you have actually done something worthy of a fine I don't think they will say you aren't liable just because the council worker took a photo while he was driving. You either did it or you didn't.

I could easily be wrong though. It's worth a shot and you never know. If you threaten to ring Leon Byner they might back off :D
