Harvey Norman busted, fined $1.25 million

HARVEY Norman has been fined $1.25 million for misleadingly advertising 3D televisions and not clearly stating some conditions in its catalogues.

The retailer's conduct was seriously misleading and deceptive, the Federal Court in Brisbane has ruled.

In September last year Harvey Norman promoted 3D televisions in conjunction with the NRL and AFL finals series', misleadingly giving the impression customers could buy a 3D television and watch the AFL and NRL grand finals in 3D format, the court found.

The 3D broadcast of both events was in fact limited to metropolitan centres, and the advertising material had been knowingly distributed to areas where no 3D broadcast was available, it was found.

Harvey Norman was also ruled to have made misleading representations about the existence of certain conditions in its catalogue and website advertising between October 2008 and July 2011.

Its website and catalogues during that period gave the impression advertised goods were available in all stores, when the offers were only being made in a single store in each state or territory.

Exactly, he has been ripping off people for years, now people have become aware of this people are not spending money at his stores. Rip off artist who hopefully goes bust very soon.

I love the lies the sales reps tell you there if they don't have stock, it's either nah they don't make that or that's last years stock. I never shop there anymore always go to jb or good guys a lot better service

Consumers know TV prices will get cheaper and are postponing purchases, particularly now that the digital switchover boom is ending.

And don’t forget Harvey is also a property owner, not a retailer — he takes his profits in rents, charges and other fees from his franchisees, whereas JB Hi-Fi, David Jones and others make the bulk of their money from selling things and taking the margin directly.

Gerry’s also cranky with consumers not merely because they’re increasingly shopping elsewhere and shifting to services, but because they now spend too much time online. We’ll regret the arrival of the internet in 10-15 years’ time, Gerry said yesterday. Gerry is of course extrapolating his own feelings onto the rest of us.

For decades, Harvey grew rich gorging on the superprofits delivered by being a gatekeeper in the retail sector, exploiting consumers’ ignorance of the vast margins Australian retailers were adding on to imported goods. The internet has exposed those margins, sending a competitive shock through much of the retail sector. That’s one of the reasons his business model is now under pressure. Now retailers have to compete, and innovate, like normal businesses.

But like every other gatekeeper, all those years of profiting on consumers’ ignorance, lack of choice and willingness to pay over the odds have wrecked Gerry’s ability to innovate.

He’s still pretty damn good at whingeing though.
