they don't have to because that amount of a coin isn't legal tender.

Australian coins for general circulation, now produced at the Royal Australian Mint in Canberra, are also legal tender, under the provisions of the Currency Act 1965,[5] but only for the following amounts:
not exceeding 20¢ if 1¢ and/or 2¢ coins are offered;
not exceeding $5 if any of 5¢, 10¢, 20¢ and 50¢ coins are offered;
not exceeding 10 times the face value if coins in the range 50¢ to $10 inclusive are offered;
to any value if face value is greater than $10 are offered.

Ask for the photo as has been suggested, if they refuse to send it to you or let you look at it, there would be the possibility that they are playing the bluff game.

You have stated that you stopped to let the school monitors cross the road, so yes you are stationary, there is nothing significant under the ARR to state that a passenger cannot alight from the vehicle, as long as it was safe to do so. Seeing the passenger didnt get collected by a passing paddle steamer it appears as though it was safe to alight from the said vehicle.

There may well be some councils use the photographic evidence line in an attempt to get people to pay fines.

I had a similar occurrence not so long ago where i got fined for parking on a yellow line. The photograph that was produced was very inconclusive and i informed the said council of that fact and the fact the matter would be contested in Court. In my closing paragraph of the letter to them I requested that their parking inspector who took the said photo bring along all of his qualifications re taking photographs in gaining evidence, his accreditations for using the camera he used and any other documents to prove he could say that the photo was genuine.

A week later i got a letter saying that no further action would be taken.

Motto of the story, get the photo. May even have been taken whilst you were moving, thus end of story

Postie has just been, he had a laugh as I told him I was waiting for it. Bastard probably left it at the Post Office to deliver next week...

So yesterday, it's been a week, I'm thinking I'm not getting a fine, but I'm still annoyed about the blokes attitude, and I'd like to know what they do with the photo's of my car so I called the Council.

Spoke to some lady who advised that yes indeed I was getting a fine, and it was for "Double Parking", I asked if she could explain how I was double parked, and the definition of double parking, and she looked at the photo's, ummed and ahhed, and put me through to the Compliance Manager.

He got on the phone and asked and told me the definition of "Double Parking". So I told him my situation, he looked up my pictures and fine, and said yes I'd been done for "Double Parking". He then went on to say I wasn't double parked after looking at the photos, but my wife alighting from the vehicle is another offence, one that I hadn't been done for :?

I told him I'd contest the "Double Parking" charge, and get this, he said they'd take it into consideration.

WTF! He's said I hadn't Double Parked, yet they're still sending out the fine for a offence I didn't do :roll:

I told him I hadn't got the fine yet, he said they're short staffed and the fine had been processed and was in the mail at yesterdays 1500hrs dispatch. Thought I'd get it today, but alas nothing....

This is the sort of shit that Leon Byner would like :lol:

Australia Post delivery times have been woeful for the last 18 months to 2 years have heard suburb to suburb mail is taking double the time to reach its destination and in one case of Meadows to Oaklands Park it was 13 days :shock: :roll:

I would contest it and state that the compliance manager said it wasn't the offence listed. Hope you wrote down his name

Gawler Council does. I paid a disputed $46 fine last year in 20c coins. Bitchface supervisor nazi told the lady at the counter who took my coins to make sure she washed her hands afterwards. If I wasn't in a good mood that day, i would have left one of the coins in my pocket & made them recount it before I found the one in my pocket,.

Jabber did you take notes of this conversation? If not, do so now, and record the time, the date and exactly what he and you said. It may help you later if they continue with the charge and you can say that the Compliance Manager had his doubts about the offence.

Which Council is it BTW?

The fact that the wife was alighting the vehicle being an offence, isn't the council's jurisdiction anyway so I'm not sure why he was commenting on it.

Fight this one, and document the conversation where they've admitted that you weren't double parked but are fining you anyway. That's just idiocy on their part.
It's all the SANFL's fault.

The passenger alighting from the vehicle would be a motoring offence that the cops could fine you for but not council, surely?

Correct. The bloke at the Council said such too....

By Thursday / Friday you'd think I'd have the letter in the mail saying they withdraw the fine....

As soon as someone enters/exits a vehicle it is classed as being parked. Regardless of the engine being on/off or if it is in gear.

Waste of time and money contesting.

FYI, don't be drunk and sit in the drivers seat of a car. You'll get done for drink driving.

No doubt. But alas the charge was for Double Parking which I wasn't.

If they wanted to ping me for something the could've said I broke regulation 171, however I was stopped at the pedestrian crossing legally, so I doubt they'd get me for that.

I can't find a regulation that states it's illegal for someone to alight the vehicle whilst stopped at a crossing....

(a) if the road is a two-way road-between the centre of the road and another vehicle that is parked at the side of the road

My vehicle wasn't "parked" between the centre of the road and another vehicle, so how could they fine me for Double Parking?
