If you are driving you can get picked up for "driving without in control of your vehicle".

I would not do it unless you wanted that fine. ;)
Is out of change.....thanks Cambridge Clarrie!!!

If it is illegal to use a handheld phone device whilst driving, I'm also assuming it is illegal to take a photo with said device, or a hand held camera whilst driving. Is this correct?

An affirmative answer may well save me $225.

The law is now not individualised to what you are doing with it. It simply is not using the hand held device why driving. That means all functions.
Read my reply. It is directed at you because you have double standards

Anyway, here's the basic details of this little mess (I sent this to a few people at the time).

"Had to pull over to answer my phone in a town outside Gawler.
Happened to be a bike lane - 11.41 on a Friday morning.
Council car happened to be behind me.
I looked in my rear view mirror, as I was going to get out of the car to talk.
Noticed a vehicle and a camera being pointed in my direction.
I thought, "that's strange".
Then it drove past and I realised it was a council car.
Anyway, I was parked there less than a minute and could still see the council car when I took off.

Forgot all about it, until I got a fine in the mail.
A bit steep considering I was there for all but a minute.
The photo shows my brake lights are on when it was taken - so he was right on to me.

I'm going to challenge it, as I think it's a "trifling matter".
But, the main point is that the council guy has broken the law to take a photo of me breaking the law.
Not quite right, is it?"

Anyway, the council involved has sent me a letter to say they've waived the fine. You beauty!

Most people probably wouldn't have argued the point. They'd have just thought, "Oh well, I can't beat it. It's not worth the effort."
