PREMIER Mike Rann faces questioning under oath in court over his alleged relationship with former waitress Michelle Chantelois - but not until after next year's election.
Mr Rann's alleged attacker, Burnside businessman Richard Wayne Phillips, yesterday foreshadowed he would plead not guilty to a charge of basic assault and would have the Premier called as a witness next year.
However, waiting lists and pre-trial legal argument mean it is almost certain Mr Rann will avoid questioning until well after the March 20 election.
Phillips, 55, arrived amid a media swarm rarely seen outside Adelaide Magistrates Court and, through his lawyer, Jon Lister, made clear his intention to fight the basic assault charge.
"Although it is his first appearance in court, I can indicate that subject to further legal advice . . . Mr Phillips wishes to defend the matter," Mr Lister said. "We anticipate the trial would incorporate the calling of all relevant witnesses, including the alleged victim (Mr Rann)."
Mr Lister said he would call Mr Rann and Ms Chantelois as witnesses in the trial, which will be heard before a magistrate next year.
"The focus of the defence will be the effect the relationship between Ms Chantelois and Mr Rann had on my client, and whether my client's alleged actions amounted to unlawful conduct," Mr Lister told magistrate Peter Snopek.
He said the defence would rely on a specific section of the law: "Conduct that lies within the limits of what would be generally accepted in the community as normal incidents of social interaction or community life cannot amount to an assault", and "conduct that is justified cannot amount to an assault".
During a 10-minute hearing, Mr Lister also said he would seek statements from Mr Rann's wife, Sasha Carruozzo, and other witnesses to the alleged assault on October 1.
Phillips allegedly used a rolled-up magazine to attack Mr Rann after the Premier had made a speech during a function at the National Wine Centre.
Last month, Ms Chantelois told Channel 7 in a paid interview that she had sex with Mr Rann in 2004 and 2005.
The next day, Mr Rann used a press conference to deny this. The Premier also pledged to launch legal action against Channel 7, and his lawyer, Michael Abbott, QC, observed yesterday's court proceedings. Pre-trial argument and trial waiting lists make it likely the trial will not be heard until well after the March 20 election.
Mr Lister also said he would be seeking clarification from police on why the charge against his client was one of basic assault.
Phillips was allegedly told by police he was to be charged with aggravated assault - a more serious charge that could be heard in front of a jury in the District Court.
Phillips replied "good" when asked how he was feeling as he left the court.
Mr Rann, who was in Brisbane yesterday for the Council of Australian Governments meeting, said it would be inappropriate for him to comment.

Attacker breaks Berlusconi's nose
Italian Prime Minister Silvio Berlusconi is being treated for a broken nose and cuts after being struck in the face at a political rally.
Mr Berlusconi was just leaving a rally in the northern city of Milan when his assailant got through security and hit the Prime Minister in the face.
Mr Berlusconi was seen looking dazed and bloodied. His injuries included a broken nose, two teeth knocked out and cuts to his lips that required stitches.
The attacker was apparently holding an object in his hand, thought to be a small statue of Milan's cathedral, before he lashed out.
Police bundled Mr Berlusconi into his car, which then pushed though a crowd of onlookers.
Police arrested a 42-year-old man, identified as Massimo Tartaglia, at the scene and took him to a police station in Milan. He was later charged with aggravated assault.
This will be seen as a major security breach and there will probably be an investigation into how the man got so close to the Prime Minister.
Mr Berlusconi will be kept in hospital overnight.
