I'd say so, but how do you find something if it isn't copyright? Do you just search all images on the internet?

Not defending the club, but asking how would you go about it? I wouldn't know where to start.
I guess it is hard as the artist has come out and said she hasn't had it on Instagram and typically she doesn't with her artwork.

So unless the image was photographed and uploaded and they did an image search it would come down to actually seeing the painting which is down at Flinders Medical Centre.

I think Port have to do away with this community engagement of the gurnseys design is n future and just go straight to an artist for this type of work.

The girl who designed this could say she's an artist, an artist is part of the community, how do you differentiate?
Quite easily. Rather than engaging with the high school students or students in general, you find an artist directly and pay them to design you.

Full contracts about IP getting handed over etc etc.

RB wrote:^You don't have to 'apply' for copyright - it automatically attaches to your work as soon as you've created it. There's no copyright register or anything like that.

So in this case I agree there's absolutely no way the Power could've known about this unless someone from the club actually saw the painting itself.

Well put, thank you.

Without trademarks or the like, how do you check it?

Purely guessing but I reckon the girl might have seen it some time ago then redrawn it without recalling it was someone else's or probably knowing the ramifications of copying someone's design.

Dont think you can sink the boots into the club for this one, all done in good faith and taken on face value, you could never be 100% any design isn't copied somehow, as long as the original artist is acknowledged then good can come out of this and play on.

FWIW I reckon it looks great.

I saw all this last night on Instagram, the original artist has looked to make sure that PAFC knows her original painting has been copied. Go on the the PAFC Instagram and read through the comments and have a look at the original artists Instagram Story.

Like people have suggested blaming the club for this is absolutely ridiculous, you seriously can't take a cheap shot and pin this on the club, how were they to know the design had been copied? Hopefully the club acts on it's statement Booney posted and this gets sorted out.

Looks like the club has removed all references from the socials, the Port store and the website about the guernsey.

Disappointing but understanding if the original artist has asked them to cease and desist. Whilst it's not exactly the same ( certainly 99% the same ) I would have liked her to have been acknowledged and move on.

Hopefully the young girl is ok.

100% this. What she did was wrong, but people on social media are cruel and vicious things that love nothing more than tearing someone down.

At the end of the day, this is a teenage girl, at school, who was simply completing a competency unit in her study.. when she was sitting there in her class, she wouldn’t have thought this would happen, she just would’ve been trying to do the best job she could.
